Delivery & Perishable Bait

  • Orders dispatched Mon–Thu, free shipping over ÂŁ70

  • All frozen/live bait is vacuum-packed and ice-packed for freshness

  • Parcels may be left with a neighbour or in a courier-deemed safe place if you’re not home

  • Delivery times are estimates — no refunds or replacements for bait that defrosts due to courier delays

  • By completing checkout, you accept these risks

Terms & Conditions of Use

1. Service & Delivery

Orders are dispatched as normal.
Free shipping applies to orders over ÂŁ70.

Delivery times are estimates only and are not guaranteed. Parcels may be delayed by 1–2 working days or more due to courier network issues including, but not limited to, hub delays, logistical disruption, or vehicle breakdowns.

While the majority of parcels are delivered next working day, delays may occur. Solent Baits accepts no liability for delivery delays outside of our control.

2. Frozen, Chilled & Live Bait Disclaimer

All frozen, chilled, and live bait orders are dispatched with ice packs and appropriate insulation. Despite this, we cannot guarantee temperature control once parcels are in the courier network.

In the event of a delivery delay:

  • No refunds, replacements, or credits will be issued for bait that arrives defrosted, damaged, or unusable.

  • This applies regardless of courier fault or delay duration.

By placing an order and accepting these Terms & Conditions at checkout, you acknowledge and accept this risk in full.

3. Acceptance of Risk

By completing checkout and ticking the Terms & Conditions box, the customer confirms that:

  • They understand delivery delays may occur

  • They accept full responsibility for the condition of bait upon delayed delivery

  • They waive any right to refund, replacement, or compensation related to delayed or defrosted bait

4. Delivery Location & Safe Place Policy

If the recipient is not present at the delivery address, parcels may be:

  • Left with a neighbour, or

  • Left in a location deemed safe by the courier.

Customers may nominate a specific safe place or delivery instruction at checkout. If no instruction is provided, delivery location is at the courier’s discretion.

Once a parcel has been marked as delivered:

  • Responsibility transfers to the customer

  • We accept no liability for loss, theft, or damage occurring after delivery

5. Posting Days

Orders are dispatched on:
Monday, Tuesday, Wednesday, and Thursday
(for next working day delivery, subject to courier performance and the terms above)

6. Collections & Local Delivery

Local deliveries and collections may be available for Portsmouth and surrounding areas by prior arrangement.

2. Contract Formation & Acceptance

A legally binding contract is formed when you complete checkout and receive order confirmation.

By placing an order and ticking the Terms & Conditions checkbox, you confirm that you have read, understood, and accepted these Terms in full.

3. Delivery Information (CRA-Compliant)

Delivery times are estimates only and are not guaranteed.

Under the Consumer Rights Act 2015, we are required to deliver goods:

  • Within the agreed time, or

  • If no time is agreed, within a reasonable time

However, delivery delays caused by third-party couriers or circumstances outside our control (including hub delays, logistical disruption, or breakdowns) do not constitute a breach of contract by Solent Baits.

4. Perishable Goods – Frozen, Chilled & Live Bait

All frozen, chilled, and live bait sold by Solent Baits is classified as perishable goods under UK consumer law.

We take reasonable care to ensure goods are:

  • Properly packed

  • Dispatched in suitable insulated packaging

  • Supplied with ice packs as standard

Once goods are handed to the courier:

  • We cannot guarantee temperature control

  • Environmental and transit conditions are outside our control

Important Legal Clarification

In accordance with the Consumer Rights Act 2015:

  • Goods must be as described, fit for purpose, and of satisfactory quality at the point of dispatch

  • We accept responsibility for any fault or defect present before dispatch

However:

  • We do not accept liability for deterioration caused by courier delay

  • No refunds, replacements, or compensation will be issued for bait that defrosts or perishes due to delayed delivery

This does not affect your statutory rights where goods are faulty or misdescribed at dispatch.

5. Assumption of Risk by the Customer

By placing an order containing frozen, chilled, or live bait, you expressly acknowledge and agree that:

  • Delivery delays may occur

  • Perishable goods may deteriorate if delayed

  • You accept this risk in full

This acceptance is confirmed when you tick the Terms & Conditions box at checkout.

6. Right to Cancel & Returns (Distance Selling Compliance)

Under the Consumer Contracts Regulations 2013:

  • Perishable goods are exempt from the 14-day right to cancel

  • Frozen, chilled, and live bait cannot be returned or refunded once dispatched

Non-perishable goods may be returned in accordance with statutory rights, provided they are unused and in original condition.

7. Delivery Location & Safe Place Policy

If no one is available to receive the parcel, the courier may:

  • Leave the parcel with a neighbour, or

  • Leave it in a safe place of their choosing

Customers may nominate a specific safe place at checkout. If no instruction is provided, delivery location is at the courier’s discretion.

Once a parcel is marked as delivered:

  • Responsibility transfers to the customer

  • We accept no liability for loss, theft, or damage after delivery

8. Limitation of Liability (CRA-Safe)

Nothing in these Terms limits or excludes liability for:

  • Death or personal injury caused by negligence

  • Fraud or fraudulent misrepresentation

  • Any matter which cannot legally be limited under UK law

Subject to the above:

  • We shall not be liable for indirect, consequential, or economic loss

  • Our liability is limited to the value of the goods supplied

Website content is provided for general information only and may change without notice. We make no guarantees as to accuracy or completeness.

Your use of website information is entirely at your own risk.

10. Data Protection

Personal data is processed in accordance with UK GDPR and the Data Protection Act 2018.

Information may be shared only where necessary to fulfil services (e.g. courier providers). We do not sell customer data.

13. Governing Law & Jurisdiction

These Terms & Conditions are governed by the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
